Terms of Service

Effective Date: October 6, 2025

These Terms of Service (“Terms”) are a legal agreement between you and GoalDaddy Breaks LLC (“GoalDaddy Breaks,” “we,” “us,” or “our”) governing your access to and use of goaldaddybreaks.com (the “Site”) and any content, features, or services we make available through the Site. By accessing or using the Site, you agree to these Terms.

1) Eligibility & Accounts

  • You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Site.
  • If you create an account, you are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account.

2) Orders, Breaks & Buybacks

  • Listings or content on the Site do not constitute binding offers; we may refuse or cancel orders at any time where legally permitted (e.g., suspected fraud, errors).
  • Divisional breaks and promotions are for entertainment; odds and comps displayed are estimates and not guarantees of outcomes or valuations.
  • Buyback offers are discretionary, depend on condition and market data, and may require authentication or additional verification.

3) Prices, Taxes & Shipping

  • Prices are in U.S. Dollars unless indicated. Taxes, shipping, and handling may be added at checkout (if applicable).
  • Risk of loss passes upon our delivery of items to the carrier. Delivery timelines are estimates, not guarantees.

4) Acceptable Use

  • Do not misuse the Site, attempt to access non-public areas, interfere with security or operations, scrape without permission, or use automated means that burden our infrastructure.
  • Do not post or transmit unlawful, defamatory, infringing, deceptive, or harmful content, or violate third-party rights.

5) Intellectual Property

All content on the Site—including text, graphics, logos, product names, designs, and software—is owned by or licensed to GoalDaddy Breaks LLC and protected by applicable laws. You may not reproduce, distribute, or create derivative works except as expressly permitted by us in writing.

6) Promotions & Messaging (Email/SMS)

  • By providing your email and/or phone number and selecting the relevant consent boxes, you agree to receive marketing messages from GoalDaddy Breaks LLC.
  • SMS: Msg & data rates may apply. Message frequency varies. Reply STOP to cancel, HELP for help. Carriers are not liable for delayed/undelivered messages.
  • You can opt out of emails via unsubscribe links and opt out of SMS via STOP at any time; doing so may not affect critical service or transactional notices where permitted by law.

7) Third-Party Services

The Site may link to or integrate third-party platforms (e.g., Whatnot, Instagram, Klaviyo). Those services are governed by their own terms and policies. We are not responsible for third-party acts or omissions.

8) Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES (EXPRESS, IMPLIED, OR STATUTORY), INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free operation, accuracy of comps/odds, or that defects will be corrected.

9) Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NEITHER GOALDADDY BREAKS LLC NOR ITS OWNERS, DIRECTORS, EMPLOYEES, OR AGENTS WILL BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS/REVENUE/GOODWILL/DATA, ARISING FROM OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, FOR THE RELEVANT TRANSACTION OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

10) Indemnity

You agree to indemnify and hold harmless GoalDaddy Breaks LLC from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your violation of these Terms or misuse of the Site.

11) Dispute Resolution; Arbitration; Class-Action Waiver

PLEASE READ THIS SECTION CAREFULLY. It requires binding arbitration of disputes and limits the manner in which you can seek relief.

  • Informal Resolution. Before filing a claim, you agree to email us at legal@goaldaddybreaks.com with a brief description of the dispute and your contact information, and we will attempt to resolve it informally within 30 days.
  • Arbitration. If not resolved, any dispute, claim, or controversy arising out of or relating to these Terms or the Site shall be determined by binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. Arbitration will be conducted in Los Angeles County, California, by a single arbitrator. The Federal Arbitration Act governs interpretation and enforcement of this arbitration provision.
  • Small Claims Exception. You or we may bring qualifying individual claims in small claims court in Los Angeles County, CA.
  • Class-Action Waiver. You and GoalDaddy Breaks LLC agree that each may bring claims against the other only in your or its individual capacity, and not as a class member or in a representative capacity. The arbitrator may not consolidate claims of more than one person or preside over any form of a representative or class proceeding.
  • Opt-Out. You may opt out of arbitration within 30 days of first agreeing to these Terms by sending written notice to:

12) Governing Law & Venue

These Terms are governed by the laws of the State of California and the United States, without regard to conflicts of law rules. Subject to the arbitration provision, the exclusive venue for any permitted court proceedings is in state or federal courts located in Los Angeles County, California, and you consent to personal jurisdiction there.

13) Changes

We may update these Terms from time to time. The “Effective Date” above reflects the latest revision. Material changes will be posted on this page; continued use after changes indicates acceptance.

14) Miscellaneous

  • Entire Agreement. These Terms constitute the entire agreement between you and us regarding the Site.
  • Severability. If any provision is held unenforceable, the remaining provisions will continue in full force and effect.
  • Assignment. You may not assign these Terms without our prior written consent.
